TERMS AND CONDITIONS OF USE, PAYMENT, CANCELLATION AND REFUND
1. Information about the merchant / operator of the Platform
1.1. This document establishes the general rules applicable to the use of the digital platform and/or the Chef Taxi application, available through the website https://cheftaxi.md/ and/or the related mobile applications.
1.2. The Platform is operated by Societatea cu Răspundere Limitată „CHEF MANAGEMENT TAXI”, abbreviated name „CHEF MANAGEMENT TAXI” S.R.L., IDNO 1026023044198, registered office: str. Grădina Botanică, nr. 14/4, MD-2032, mun. Chișinău, Republica Moldova.

1.4. In this document, „CHEF MANAGEMENT TAXI” S.R.L. may be referred to as the “Company”, “Chef Taxi”, the “Platform”, “we” or “us”.
2. Acceptance of the document
2.1. By performing, separately or cumulatively, any of the following actions: accessing the Website, installing the Application, creating an account, placing an order, using the services available through the Platform, or making a payment, the User confirms that they have read, understood, agree with and accept this document and the applicable appendices.
2.2. If the User does not agree with this document, they must cease using the Platform and must not place orders through it.
2.3. Before completing an order or a transaction, the User may be asked to confirm acceptance of this document, the applicable appendices and the Privacy and Security Policy.
3. General definitions
3.1. The Chef Taxi Platform / Application means the digital system, the website, the mobile application and the technical infrastructure managed by the Company.
3.2. User / Client / Passenger means the natural person who uses the Platform to place an order, pay for services or benefit from the services facilitated through the Platform.
3.3. Order means the request placed by the User through the Platform for the provision of a service available through the Platform.
3.4. Platform Services means digital services of intermediation, facilitation, order management, communication, support, display of fares, payment processing and other functions available through the Platform.
3.5. Person executing the order means the Driver, Courier, Carrier, Transport Partner or other independent person who accepts and executes an order through the Platform.
3.6. Fare means the amount due for the services available through the Platform and/or for other applicable costs, charges or commissions, displayed or calculated through the Platform.
3.7. Electronic receipt / electronic confirmation means the document or electronic confirmation made available to the User for the order placed through the Platform.
4. The role of Chef Taxi as a digital platform
4.1. Chef Taxi is a local digital platform in the Republic of Moldova that facilitates the request, acceptance and management of orders for the services available through the Platform.
4.2. The Company does not directly provide passenger transport services and does not act, merely by operating the Platform, as a carrier. The actual services are provided by independent persons who accept and execute the orders through the Platform.
4.3. The Company manages the Platform, facilitates the placing of orders, the display of fares, communication, payment processing, customer support and the issuance or making available of the electronic receipt or the electronic confirmation.
5. Available services and applicable appendices
5.1. The types of services available through the Platform are described in Appendix No. 1 – Types of services available through the Platform.
5.2. Fares, payment methods, cancellation and refund rules are described in Appendix No. 2 – Fares, payment methods, cancellation and refund.
5.3. Delivery services are governed by Appendix No. 3 – Special conditions for delivery services.
5.4. In the event of a discrepancy between this document and a special appendix, the special appendix shall apply with priority for the respective service.
6. Use of the Platform and the User's account
6.1. In order to use certain functions, the User may be required to create an account and provide the data necessary for placing and executing orders.
6.2. The User is responsible for the accuracy of the data provided through the Platform and undertakes not to provide false, incomplete or incorrect data, or data belonging to another person without authorization.
6.3. The Company may limit, suspend or block the User's access to the Platform in the event of a breach of this document, fraudulent, abusive or unauthorized use, reasonable suspicion of fraud, infringement of the rights of other persons or breach of applicable legal obligations.
7. Placing and accepting orders
7.1. The User may place an order through the Platform by indicating the information requested in the application's interface.
7.2. The order is transmitted to available persons who may accept and execute the order. Acceptance of the order will be displayed in the Platform.
7.3. The contract for the actual provision of the service is deemed concluded between the User and the person who accepts and executes the order, under the conditions displayed in the Platform and in accordance with applicable law.
7.4. Estimates regarding arrival time, duration, route or cost may be indicative.
8. Fares and costs
8.1. The applicable fares and costs are displayed in the Platform before confirmation of the order or at the time the relevant functionality is used.
8.2. The fare may be fixed, estimated or calculated according to the parameters of the order, including distance, duration, location, demand, fare class, waiting time, special conditions or other applicable elements.
8.3. Details regarding fares, waiting costs, cancellation charges and other costs are provided in the Platform and/or in Appendix No. 2.
9. Payment
9.1. The User may pay for orders through the methods available in the Platform.
9.2. Electronic payments are processed through the acquiring bank and/or the payment processor with which the Company cooperates at the time the transaction is carried out.
9.3. The Company does not store the full bank card number, the CVV/CVC code or other complete card data.
10. Electronic receipt
10.1. For all orders placed through the Platform, regardless of the payment method used, including cash payment, the User is provided with an electronic receipt and/or an electronic confirmation, in accordance with the applicable legislation of the Republic of Moldova and the applicable rules.
10.2. The electronic receipt is sent to the e-mail address indicated by the User and/or by other means available in the Platform, if these are enabled.
10.3. The content of the electronic receipt may vary depending on the payment method, the type of order and the applicable technical or legal requirements.
11. Cancellation and refund
11.1. The User may cancel the order under the conditions displayed in the Platform and in the applicable appendices.
11.2. Cancellation of the order may be free of charge or may incur costs, depending on the time of cancellation, the status of the order, the travel of the person executing the order, the waiting time and other conditions displayed in the Platform.
11.3. Refund requests are examined within up to 24 hours of receiving all the necessary information. The actual time for crediting the amount may depend on the bank, the payment processor, the payment systems or other applicable rules.
11.4. Refunds of amounts paid are made at the Platform's discretion, taking into account the circumstances of each specific case, the applicable rules and the existence of the technical possibility of carrying out the refund. If the refund is approved by the Platform, it will, as a rule, be made through the same payment method used by the User for the initial transaction, if this is technically possible.
11.5. The User's rights as a consumer, including the right to information, to lodge complaints and to a refund, are guaranteed by Law No. 105/2003 on Consumer Protection, as well as by other applicable normative acts of the Republic of Moldova.
12. Return and exchange
12.1. The services available through the Platform are digital intermediation services and/or services facilitated through the application. Under this document, the Company does not sell physical goods to Users, except where such a service is expressly enabled and separately regulated in the Platform.
12.2. Physical return of products or exchange of products does not apply with respect to the Company.
13. Complaints and support
13.1. For questions, complaints or requests regarding orders, payments, cancellations, refunds or the operation of the Platform, the User may contact customer support at Support@cheftaxi.md or at the number 078800822.
13.2. The User must provide the information necessary to identify the order or transaction.
14. Obligations of the User
14.1. The User undertakes to use the Platform legally, correctly and in good faith, to provide accurate data, to pay the applicable costs, not to use the Platform for fraudulent, abusive or illegal purposes, and to comply with the rules applicable to the ordered service.
15. Limitation of liability
15.1. The Company makes reasonable efforts to ensure the proper operation of the Platform, but does not guarantee its uninterrupted, error-free or permanently available operation.
15.2. The Company is not liable for technical interruptions, the temporary unavailability of the Platform or of third-party services, the operation of networks, banking systems or payment processors, incorrect information provided by the User, the acts or omissions of the persons executing the orders, or external circumstances beyond the Company's control.
15.3. This limitation of liability does not apply in cases where applicable law prohibits the limitation or exclusion of liability.
16. Personal data
16.1. The processing of personal data is carried out in accordance with the Company's Privacy and Security Policy, available on the website and/or in the application.
17. Amendment of the document and of the variable conditions
17.1. The Company may amend this document, the applicable appendices and the variable conditions, including the types of services, the fares, the payment methods, the service areas, the technical limits and the operational rules.
17.2. The conditions applicable to an order are those displayed in the Platform at the time the order is placed or confirmed.
18. Applicable law and disputes
18.1. This document is governed by the legislation of the Republic of Moldova.
18.2. Any complaint or dispute will be resolved, first of all, amicably, by contacting customer support.
18.3. If the dispute cannot be resolved amicably, it will be resolved by the competent courts or the competent authorities of the Republic of Moldova, in accordance with applicable law.
19. Language versions
19.1. This document may be available in Romanian, Russian, English and/or other languages.
19.2. In the event of discrepancies between the language versions, the Romanian version shall prevail, unless applicable law requires otherwise.

APPENDIX NO. 1 – TYPES OF SERVICES AVAILABLE THROUGH THE PLATFORM
1. Scope of the appendix
1.1. This Appendix describes the types of services that may be available through the Chef Taxi Platform.
1.2. A service is available to the User only if it is enabled and displayed in the interface of the Platform.
2. Passenger transport
2.1. The passenger transport service allows the User to request, through the Platform, transport from a pick-up location to an indicated destination.
2.2. The actual service is provided by independent Drivers, Carriers or Transport Partners.
3. Delivery
3.1. The delivery service allows the request for the pick-up of a Shipment from the Sender and its delivery to the Recipient, without the Shipment being accompanied by a passenger.
3.2. The delivery service is available from the launch of the Platform, to the extent that it is enabled in the application's interface.
3.3. Delivery services are governed by Appendix No. 3.
4. Other services
4.1. The Platform may also include other services, such as pre-booking, services to or from the airport, intercity services, corporate services or other services, if these are enabled and displayed in the Platform.
4.2. Special conditions, special fares or additional rules displayed in the Platform or provided in the applicable appendices may apply to certain services.
APPENDIX NO. 2 – FARES, PAYMENT METHODS, CANCELLATION AND REFUND
1. Fares
1.1. The applicable fares are displayed in the Platform before confirmation of the order or at the time the relevant functionality is used.
1.2. Fares may vary depending on the type of service, distance, duration, area, demand, fare class, waiting time, special conditions or other elements displayed in the Platform.
1.3. The Company is not obliged to maintain the same fares for all orders, periods, areas or types of services.
APPENDIX NO. 3 – SPECIAL CONDITIONS FOR DELIVERY SERVICES
1. Scope of application
1.1. This Appendix establishes the special conditions applicable to the delivery services available through the Chef Taxi Platform.
1.2. The delivery service allows the Sender to request the pick-up of a Shipment from an indicated address and its delivery to the Recipient, without the Shipment being accompanied by a passenger.
2. Special definitions
2.1. Shipment / Parcel means the good, package, document, parcel, bag, pouch, box or other item handed over for delivery through the Platform.
2.2. Sender means the person who places the delivery order, hands over the Shipment and is responsible for the content, packaging and legality of the Shipment.
2.3. Recipient means the person indicated by the Sender to receive the Shipment.
2.4. Courier means the person who accepts and executes a delivery order through the Platform.
3. The role of the Platform
3.1. Chef Taxi acts as a digital platform / aggregator that facilitates the placing, acceptance and management of delivery orders.
3.2. The Company is not the owner of the Shipment, does not sell the goods handed over, does not verify the economic value of the Shipment and does not act as a depositary, postal operator, escrow service, cashier, cash collection agent or financial services provider.
4. Requirements for the Shipment
4.1. The Shipment must be properly packaged, closed, safe for transport and ready for handover at the time of the Courier's arrival.
4.2. The weight of the Shipment must not exceed 20 kg, except where another limit is expressly indicated in the Platform.
4.3. The Shipment must be capable of being transported freely and safely in the cabin or trunk of the vehicle, without damaging or soiling the vehicle and without impeding safe driving.
5. Packaging
5.1. The Shipment must be packaged in a package, box, bag, pouch, envelope or other packaging appropriate to the nature of the Shipment.
5.2. The packaging must be closed, clean, durable and must not allow accidental opening, leakage, tearing, damage or loss of the content during transport.
5.3. Fragile items must be specially packaged. In the absence of adequate packaging, the risk of damage to fragile items lies with the Sender.
6. Permitted Shipments
6.1. Through the delivery services, in compliance with this Appendix and applicable law, documents, clothing, accessories, flowers, small packages, bags, pouches, small parcels, small luggage, small suitcases and other items that are not prohibited may be sent.
7. Prohibited Shipments
7.1. It is prohibited to send through the Platform cash, bank cards, valuables, jewelry, weapons, ammunition, explosives, drugs, psychotropic substances, animals, dangerous substances, perishable products without a special regime, illegal, stolen, counterfeit or bulky items, or items that may endanger persons, property, the vehicle or the environment.
8. Right of refusal
8.1. The Company, the Courier or the Transport Partner may refuse to pick up or deliver a Shipment if it does not comply with this Appendix, the main document, the rules displayed in the Platform or applicable law.
8.2. The Courier is not obliged to open, verify or inspect the content of the Shipment.
9. Obligations of the Sender
9.1. The Sender undertakes to provide accurate data, to package the Shipment properly, not to send prohibited items, to ensure that the Shipment can be transported legally and safely, and to bear the costs generated by incorrect information, the Recipient's refusal, the impossibility of delivery or a breach of this Appendix.
10. Recipient and failed delivery
10.1. The Sender is responsible for correctly indicating the Recipient's data.
10.2. If the Recipient does not respond, is not at the indicated address, refuses to receive the Shipment or the address is incorrect, the delivery may be considered failed.
10.3. In the event of a failed delivery, the Shipment may be returned to the Sender, and the related costs may be borne by the Sender.
11. Payment for delivery
11.1. The cost of the delivery service is displayed or calculated through the Platform.
11.2. The cost of the delivery service may be paid by the Sender or by the Recipient, if this functionality is available in the Platform.
11.3. Payment by the Recipient relates exclusively to the cost of the delivery service and does not represent payment of the value of the goods, cash on delivery, cash collection, escrow service, postal service or financial service.
12. Confirmation of delivery
12.1. Delivery may be confirmed by status in the application, photograph, confirmation code, signature, phone call, message or other method available in the Platform.
13. Liability
13.1. The Sender is responsible for the content, legality, packaging, description and handover of the Shipment.
13.2. The Company does not verify the value, quality, authenticity, legality or conformity of the content of the Shipment.
13.3. To the extent permitted by law, the total liability of the Platform for a delivery order shall not exceed the value of the delivery service paid for the respective order.
14. Complaints regarding delivery
14.1. Complaints regarding loss, damage or improper delivery must be submitted within no more than 24 hours from the time of delivery or from the time at which the delivery should have been carried out.
14.2. Complaints are submitted to Support@cheftaxi.md or through other channels available in the Platform.
15. Personal data
15.1. For the provision of delivery services, the Company may process data of the Sender and the Recipient, including first name, last name, phone number, pick-up address, delivery address, information regarding the order, the delivery status and other data necessary for the execution of the order.
15.2. The Sender declares that they have the right to provide the Recipient's data for the purpose of carrying out the delivery.
